Former Reagan Constitutional Lawyer Has Written an Obama Impeachment Argument

My wonderful son-in-law knows I sleep-in on Saturdays, so he always finds a reason to ring my cell phone to wake me. This morning he informed me he had heard (on a talk radio program he listens to) that someone had written a 15-page impeachment paper against Obama.

Sure enough

A prominent libertarian constitutional lawyer and civil libertarian has drafted an article of impeachment against President Obama over his attack on Libya, throwing down a legal gauntlet that could be picked up by some Congressional Republicans

Bruce Fein, a former Reagan administration official in the Department of Justice and chairman of American Freedom Agenda writes in his 15-page argument of Obama’s course that “Barack Hussein Obama has mocked the rule of law, endangered the very existence of the Republic and the liberties of the people, and perpetrated an impeachable high crime and misdemeanor.”

Fein is a small-government conservative who worked on the impeachment of President Bill Clinton and also called for the impeachment of President George W. Bush and Vice President Dick Cheney, and his work doesn’t represent the Republican Party line. But it comes as some Republicans on the Hill, led by Senator Rand Paul, object vociferously to Obama’s decision to strike targets in Libya without Congressional authorization.

“If he can wipe out the war powers authorization, why can’t he wipe out Congress’s authority to spend?” asked Fein. ” If we’re going to be a government of laws, and not descend into empire, this is Caesar crossing the Rubicon.”

Fein said a number of Congressional offices have expressed interest in his proposal.

“They actually need to defend constitutional prerogatives,” said Fein. “There’s definitely been interest on the Hill. There’s at least two dozen who have been open to the idea that this is a serious constitutional crisis.”

The Politico piece lays out Fein’s Articles of Impeachment of Barack Hussein Obama.

I doubt this would (or even should) go anywhere. Like it or not, Obama might very well be within his rights as Commander in Chief with the Libya fiasco … Depending on, of course, who is splitting those hairs, in this case Obama’s top junkyard dog lawyer (whose defense of Obama is 14-pages) and whose DOJ has had no problems rewritting lots of other legal stuff in just under three years. However, it should be noted that talk is we will have boots on the ground in Libya before long. (Why else are Marines sitting on ships in the Mediterranean?) At some point, whatever ‘freedoms’ a POTUS has Constitutionally in these circumstances would be crossing the line and then be in violation.

While this might be the most prominent argument to take this administration to legal task over, (and I argue there have been others since he took office that have been in stark contrast to the US Constitution with the help of the then democrat leadership in the US Congress), I do have to ponder if this were a republican POTUS how the MSM would be running frantically wall-to-wall with this and giving Fein loads of face time on their networks. Not only that, but offering him advice on more articles to add to the 15-pages. You know I’m right …

  1. We need to spend our energy overturning Obamacare and cutting spending.
    I strongly recommend a book for everyone here to read, and I wish I could get even one liberal to consider reading it.
    The New Road to Serfdom by Daniel Hannan, that member of Parliament who gave a wonderful pro American rant that went viral on youtube. The book has big print and is easy to read and short. It is so clear I wish I could hear how a liberal would counter his arguments.
